A very common misconception about bond for deeds is the belief that their terms must match—or somehow track—the terms of an existing mortgage. This is not correct.

While many bond for deed transactions do involve an underlying mortgage, not all do. But when an underlying mortgage does exist, it is critical to understand that two entirely separate agreements are at work.

Two Separate Contracts, Two Separate Negotiations

  1. The underlying mortgage
  • This is a contract between the seller and the mortgage lender
  • Its terms and conditions (interest rate, maturity, payment structure, etc.) are negotiated solely between those two parties and are documented in the loan agreement
  1. The bond for deed
  • This is a contract between the buyer and the seller
  • Its terms and conditions are negotiated independently and documented in the bond for deed agreement

There is no requirement—legal or practical—that the bond for deed mirror the mortgage.

No Required Correlation Between Terms

Specifically:

  • The interest rate on the bond for deed does not have to match the mortgage interest rate
  • The amortization term does not have to match the mortgage term
  • The balloon period, payment structure, and escrow arrangements can all be different

These are two separate financial arrangements, serving two different relationships.

Why This Matters

This misunderstanding often causes unnecessary hesitation or confusion when buyers or sellers consider a bond for deed involving an underlying mortgage.

In reality, the flexibility of the bond for deed allows the seller to:

  • Structure buyer payments in a way that makes the transaction viable
  • Accommodate affordability, credit-repair timelines, or refinance goals
  • Negotiate terms that make sense for the buyer without being constrained by lender terms

The Bottom Line

When a bond for deed has an underlying mortgage:

  • The mortgage governs the relationship between seller and lender
  • The bond for deed governs the relationship between buyer and seller
  • The two sets of terms are independent and fully negotiable

Understanding this separation is essential to properly structuring bond for deed transactions and avoiding one of the most common myths surrounding them.
