Why a Servicer Matters Most the Week After a Storm

After storms like Bertha and Edouard, the seller-financed deals that stay clean have a third party keeping records and taking payments.

A mailbox stands by crashing waves and a stilt house as a glowing digital circuit board floats in the sky.

A title company gets a file where a buyer and seller in a seller-financed deal need to close a refinance. The catch is they managed the payments themselves for the last two years. The closing attorney asks for the payment history. The seller hands over a spiral notebook filled with crossed-out dates and notes about checks delayed by storm evacuations. The refinance stops cold because the new lender cannot verify a single on-time payment.

This problem surfaces quickly after severe weather hits the coast. This season alone brought Tropical Storm Bertha into St. Bernard Parish with 45 mph winds on July 22, followed by Tropical Storm Edouard making landfall near Johnson Bayou on September 1 with 60 mph winds, leaving more than 150,000 customers without power. The threat is constant; four storms between August 2020 and 2021 caused an estimated $22 billion in insured losses in Louisiana. When a storm disrupts the grid, power goes out and mail stops moving. Those disruptions test exactly how well a private mortgage or Bond for Deed is being managed.

The Week After the Storm

The week following a landfalling storm is chaotic for everyone. Buyers might be evacuated, and sellers might be focused on their own property damage. When a payment is due on the first of the month and Edouard hits the Louisiana coast, self-serviced deals often devolve into a confusing mix of text messages and delayed checks. The buyer asks for extra time, the seller agrees informally, and suddenly the actual due date and grace period are completely lost.

Back in the day, a buyer and seller might have safely tracked their monthly payments in a spiral notebook. Today, trying to save a small monthly servicing fee usually costs both parties more in the long run. When an independent third party handles the account, the emotional and logistical friction disappears. An escrow agent like Escrow Services collects the payments, tracks the balances, and manages the tax and insurance reserves automatically.

Our system relies on simple ACH billing for the automated monthly collection and disbursement of principal, interest, taxes, and insurance. The draft happens on the due date regardless of whether the buyer is sitting in their living room or in an evacuation hotel in another state. We use an ACH direct payment authorization to make sure the funds move securely. If a payment is not received within the ten-day grace period, a late fee is applied automatically.

Why Professional Servicing Matters

We serve as a neutral third party in these seller-financed real estate deals. Our role is strictly to manage the contracts, collect the payments, and ensure every detail is handled properly. We do not act as a collection agency or property manager. The goal is simply to keep an exact, unalterable record of what was paid and when it was paid. This protects both the Purchaser and the Seller from the inevitable memory lapses that follow a stressful month.

Payments on a mortgaged property sold by Bond for Deed must go to a bank or licensed escrow agent under La. R.S. 9:2943. Non-bank bond for deed escrow agents are licensed separately by the Office of Financial Institutions. To obtain and hold this license, an agent must maintain a surety bond or deposit in trust of at least $10,000, demonstrate a net worth of at least $25,000, and keep records at the licensed location for three years. Licensees must keep an escrow deposit account at a federally insured depository institution solely for buyers' monthly payments, holding all funds in trust from receipt without commingling them with their own funds. The escrow agent distributes each payment between the seller and the existing mortgage holder in the proper proportion. This ensures the underlying mortgage is actually being paid while the buyer works toward obtaining clear title.

During storm season, making sure the underlying mortgage and the insurance premiums are paid is vital. We manage the tax and insurance escrows so that policies do not lapse right when a named storm is spinning in the Gulf. This is especially critical in today's market, where named-storm deductibles typically run two to five percent of the insured value. When the buyer's single payment comes in, we ensure the underlying lender is paid first, removing any guesswork about whether the seller remembered to forward the funds.

Setup and Ongoing Administration

Getting a file set up correctly before the wind starts blowing is the only way to ensure the payments keep flowing. When a title company or attorney sends us the Document Preparation Form, we draft the closing documents, send a draft for approval, and then email the final closing documents. The onboarding checklist includes the executed agreement, W-9 forms for the buyer and seller, the next due date, the current mortgage statement, insurance declarations, and the tax bill. Having all of these documents properly filed with a licensed escrow agent means the records are secure and accessible.

Once the account is active, our monthly servicing fees cover all the essential administration. Our flat monthly fee covers full account management, issuing payoffs, and handling borrower questions. Under our private mortgage servicing, we collect and disburse monthly payments, manage balances, handle tax and insurance reserves, manage HOA dues, issue monthly statements, and complete IRS filings. For lease purchases, we collect rent, protect buyer funds, track escrow coverage, and maintain the distinct rent credit ledgers and option money records needed to help buyers exercise their option through a refinance. We maintain an arms-length transaction between the lender and borrower at all times. If a buyer needs a payoff statement to close their refinance, we provide one that gives the principal and per diem interest to the exact closing date.

Preserving the Exit Strategy

Every successful Bond for Deed or private mortgage eventually ends in a payoff or a refinance. To get a conventional loan, the buyer must prove they made their payments on time. Mortgage underwriters view payments made to a licensed escrow agent as mortgage payments to an independent third party. They treat the new buyer mortgage as a refinance rather than a purchase loan, which often comes with better terms.

If the parties tried to handle the money themselves, that proof simply does not exist in a format a bank will accept. Providing a complete third party account history is one of the most critical services we offer. It facilitates refinancing, the sale of notes, or even foreclosure if that unfortunate need arises. We provide these third-party account histories and payoff statements to help buyers refinance and take title.

We are licensed, examined, and bonded by the Louisiana Office of Financial Institutions. This is the same regulatory body that regulates banks and savings and loans. Our fee structure is designed for individual sellers and small investors to provide institutional-quality servicing at a price point that makes sense. For a Bond for Deed, the one-time setup fee is $475 with a monthly service fee of $40, and the parties choose whether the buyer or seller pays that monthly fee. Private mortgage servicing runs just a $150 setup fee and $25 a month.
